If Lotus Group has registered its trade marks (which I believe it has) and if the green and yellow colour combination is a characteristic of its trade mark designs, which it is, then I think they'd have a good case that Team Lotus, operating racing cars and using its brand colours, is guilty of "passing off", i.e. that there is a substantial likelihood that people will think Team Lotus and Group Lotus are one and the same. It doesn't matter who owned the original Team Lotus brand if they haven't objected to Group Lotus branding its cars as Lotus in the last ten years. Trade Marks do not last forever and if you don't defend them you lose the right to use them.

Legal issues aside, everyone seems very quick to criticize this team. Sure, they are scrabbling among the backmarkers right now, but they did a remarkable job making the grid with all of five months to build an F1 team. They've also gone out of their way to respect the legacy of the original Team Lotus, and they have the blessings of no less than Clive Chapman. That's good enough for me. I'm betting that next year's car is going to pull them up the grid. And in a few years, I hope they're competing for podiums.
