It gets worse

In the light of the data which Pirelli did in fact pass to Mercedes by way of the confidential email referred to under paragraph 37.8 above relating to trackside engineering reports, it is plain beyond sensible argument that Pirelli had intended confidentially to pass some data to Mercedes, which Pirelli expressly regarded as being of high importance even if, as we accept, it was in fact of limited value to Mercedes because it was unaware of the tyres to which the report related.

Both Mercedes and Pirelli, accordingly, did act in breach of articles 1 and 151 ISC.

I think everybody knows that the test was illegal, including Mercedes.

However, the email from Charlie is what saved their bacon. Even though his interpretation is completely wrong, he is employed by the FIA & as such speaks for them ... & that left the Tribunal unable to suitably penalise Mercedes.

I would think that Charlie will be facing some music of his own, & it won't be long before the FIA change some policies, procedures & wording in the rules to ensure their hands aren't tied like this again.

any advantage gained was negligible..........

Really, current car, current driver and magically win the next race, actually they should have had a 1-2 in the next race but Hamilton made a rookie mistake..........

It was cheating, I imagine Brawn made a call to Todt and it was sorted.

Whitew, I think the deal may have been made higher up than Brawn and Todt, I'm thinking along the lines of Lauda and Bernie agreeing that Mercedes pulling out would be a bad thing, so lets agree a little slap on the wrists but we'll have a pointless tribunal just to make it look above board.

I remember when news of the test came out, everybody on this site was talking about bans, £100m fines, excluded from the champioship and so on. So for all of those people, and i see some are still saying it, move on, get over it, sentence has been handed out, whether you agree with it or not.
