35. where have I said I dispute the verdict. I have repeatedly said that there were three sides at fault, and even though I might not think the penalty decision was right, I have said that we have to accept it. all I have been doing is straightening some facts that others have been getting confused about. even before the tribunal held that Charlie had no authority to allow the test, I pointed that out, and was shot down by a number of posters.
another fact that confuses some is that Pirelli did not ask for a 2013 car. they invited Ferrari, rbr and merc to "a test". it was merc saying they did not have a 2011 car available, who initiated all this 2013 car problem.
merc "misunderstood" Charlie, and all the hoohaa began.

Richard from what i understand at the moment pirelli can use any car right up to todays under there agreement and as this was a pirelli test not merc as pirelli paid for the track time unlike ferrari who hired there track for a (pirelli) test and getting the basic ok in email from the fai then merc went ahead under handed yes but also clever

kiwi. not quite right. Pirelli must abide by the f1 rules and sporting codes. it says so in their contract with fia. it does not specifically exclude any car as it would be utter madness to mention EVERY rule in the contract, but if fia have a rule saying that current car cannot be used, then Pirelli are legally and morally bound to abide by that.
it was merc who inserted the 2013 car into the equation, and Pirelli expected merc to get an all clear, an all clear they did not get, but thought that charlies opinion was the go ahead.
in my OPINION, there was "manufactured" confusion, but this is my OPINION !
