IF Pirelli did not give other teams the chance, it is THEIR fault, NOT Mercedes.
IF Pirelli/Mercedes got permission to use a current car, Mercedes are not in error.
IF the tyres were unmarked and no informationwas divulged to the team, Mercedes have not gained. Yes, the drivers have 'gained' some miles, but this is no gain if they are not able to collect data from it.
This all revolves around whether FIA actually permitted the current car to be used.
