Honda did it, Renault did it, McLaren did it (with Mercedes as a large stakeholder), Michelin did it, Ferrari did it, Toyota got away with it, Williams did it in 1982, Benneton (with Ford) did it in 1994.
Toyota cot caught with their WRC cars in 1995.
Many companies do a lot of illegal or stupid things that can get them into serious trouble. Someone simply takes the decision that the risk is worth it or takes a gamble that they won't get caught.
To assume that Mercedes or Pirelli would not do such a thing is naive.
