Difference would be that Red Bull could not use the excuse that they were acting in good faith and that they thought that the FIA had sanctioned the test - unfortunately that barn door has now been closed by Mercedes on their way out! Red Bull have been saying it is wrong and contrary to the rules so if they now go ahead and do it themselves they could find themselves in a lot more hot water than Mercedes.
