If, as seems likely, Schwantz was advised reliably by his legal counsel, his statements with respect to COTA would be correct. The agreement cited (signed, in writing?--it is not 100% clear whether it was written or verbal, but the implication is that it was a written contract) seems to indicate that COTA and 3fourTexasMGP had an explicit and legally binding relationship. The DORNA response will be interesting to see, especially since the 2013 race schedule is reportedly about to be released.
Schwantz is a sound, reliable individual with huge MotoGP experience beyond his world championship, and COTA would benefit enormously from his involvement. He is also greatly respected in the MotoGP community, and it is disappointing this this kerfuffle would erupt at a critical juncture in the development of the Austin track and MotoGP in America.

If COTA did release a press statement acknowledging that an agreement was in place, the fact that there was no written contract may not be relevant. They have implied that there was an agreement and KS did not deny it at that time, therefore COTA have benefited from the perception that KS was involved.
if nothing else. KS is entitled to recompense from COTA for the use of his name.
Verbal agreements in situations like this where an opportunity is being explored speculatively are not uncommon.

COTA has already been sued by one person that was illegally forced out after the agreement with DORNA was reached. They seem like a really shady organization that will hopefully get what they deserve.

Wether Kevin had a written or verbal agreement with COTA and DORNA. He has the right to be in all sorts of negotiation end of story. Many people believes that the black and white is the only agreement that should be honored. Wrong! Agreement is an agreement wether it is a Verbal. But on the eyes of the law verbal agreement between party is as good as written agreement. And it will always be honored by judge and in the court law. GO GET THEM KEVIN!

The agreement was with Tavo Hellmund, who has conveniently been forced out by his partners. They then did precisely what Kevin is Accusing them of. "Tavo Hellmund, who is this Tavo Hellmund fellow"? Be interesting to see how their F1 race works out. Ecclestone will eat these clowns for breakfast if they aren't on their game! The look on Kev's face is priceless. "You dirty sons of B#$%##$"!
