Nothing to stop any of Spies' low mileage factory motors or the factory software package being passed down to Tech 3. (Though I agree it's unlikely.)
Yep, Dovi has been better. He should be. This is his 11th season riding these circuits and his 5th in MotoGP. In his 2nd year - on a full factory Honda - he managed only 1 podium and amassed 160 points at season's end - not too dissimilar to what Crutchlow might tally this year.
For a valid comparison let's see how Cal is performing in his 5th year, and see how that stacks up against what Dovi managed this year. Fair?
