Kevin Kalkhoven was smiling after session ended for the day on Thursday after another day of testimony at Oakland District (Federal) Court.
The Champ Car series and team co-owner is one of four former executives of JDS Uniphase in the dock as defendants in a class-action lawsuit alleging insider dealing violations of Securities and Exchange Commission.
Kalkhoven, who has his own separate legal team, was pleased with Thursday's testimony, claiming that the plaintiffs witness was 'destroyed' by the lead attorney for the other defendants, and adding that 'it's been a good two days'. In addition to the ‘live' witness, the nine jurors also saw videotaped depositions from two other witnesses. One of the plaintiffs' attorneys estimated that his side would be presenting evidence through 1 November.
Kalkhoven admitted that he had no idea how many witnesses the defendants would call, but revealed that his part of the evidentiary hearing wouldn't come until the end of the case. He said his part in the allegations is small and short. Among those allegations is one that the JDSU executives made misrepresentations between 25 April 2000 and 26 July 2000, while selling their stock in the company.
Kalkhoven retired from JDSU on 17 May 2000.
