NASCAR overturns 100-point penalty to Robby Gordon following appeal hearing.

However, the Commission recognised that Gordon's last minute decision to align his team with Dodge and Gillett-Evernham Motorsports, which was partly prompted by the cancellation of the Dakar Rally and a personal loss of about $4 Million, were an extraordinary and unusual set of circumstances.

While the circumstances surrounding Gordon's team were not deemed to excuse the unapproved body part infraction (thus the increased fine for Kerr), the NASCAR Commission decided to reinstate the car owner and driver championship points and lift Kerr's suspension.
