@richard, despite request by the court, Sauber have made zero effort to comply to the previous court orders. All they had to do was start acting, but they haven't. Yeah, maybe their is some big plan behind it all, but Sauber facilitates it by not listening to the court orders. They already could have made a seat, arranged a new overall, apply for the superlicense, but none of that. If it is a plan by Papa inlaw, than Monica must be involved in this scheme.

Anything the FIA will say about safety will open a can of worms. They better say nothing at all. But the problem for them is also, if the court does agree that it is unsafe, they have a liability problem when something goes wrong in other teams. Making it a hazard to race in Australia ever again, even putting this years race in danger. Sauber, with this argumentation, is pissing off just about everyone. I can imagine Todt and Bernie to be on the phone with Sauber people as we speak to drop the case.

@rbr46 The future of the team was jeopardised the moment Kaltenborn signed more contracts that she had seats available, without looking at the actual and factual legal situation she was creating at that point. Even if they want to pay off Van der Garde, the team is not in a position to do so and will bankrupt as a result. If I were Nasr or Ericsson or their sponsor I'd look at a way out as we speak, because the chance that Sauber will not make it past half the season is growing every minute.

There will also come a conflict over sponsorship position on the car. If Sauber fail to put McGregor on the car in Melbourne in the size and position they agreed in the sponsorship contract, Sauber are in breach of that contract. At that point VdG has fullfilled his contract but Sauber screwed up the sponsorship deal. A season of free racing.... I think we can all agree that no sponsor ever again will pay money upfront if something like this can happen.

The judge has asked for a FIA representative to clarify the safety issues. That will open a can of worms with the Mehri contract and several young inexperienced drivers if they'd rule that a guy who raced many F1 races in several cars as well as GP2 and other international open wheel series is unable to race a Sauber. It will also make it impossible to replace sick drivers with inexperienced young drivers. Any friday practice outing would be to dangerous by that logic. Doubt that the FIA want to touch this.
