F1 » Van der Garde begins legal hearing against Sauber

Latest info: - Swiss ruling is from last week, so very recent - In Australia they will only ask for enforcement of the Swiss ruling, which is usually granted (Switzerland is used for a lot of international arbitration as well) - If it is granted, he can go onto the paddoch with police and claim his seat or get the people preventing that arrested The stakes are high.

F1 » Van der Garde begins legal hearing against Sauber

The problem is that Nasr's people pay money so the team can perform. If most of that money now flows out because of a lawsuit, Sauber could be in breach of that contract and the payments will be canceled. Whatever way it goes, financially it will not be good for Sauber. But they have created that situation themselves by siging an terminating multiple contracts while neglecting actual law. I repeat, they have already been informed that the Van der Garde contract is still valid. And as it was the first signed, it prevails the others.

richard: if i am correct, it will be FRENCH law that would prevail.
I don't think you are correct. Why would France have legal jurisdiction? Sauber is a Swiss company, so the contract would have been executed in Switzerland and apparently broken in Switzerland. How does France have anything to do with it? Don't say because the FIA is in France - they have nothing to do with the contract between a driver and his or her employer.
all contracts are controlled and approved by the fia and are subject to french rulings!
I assume you mean the Contract Recognition Board? It is based in Switzerland.... However, it seems to be set up for cases where teams dispute a contract from a driver at another team. So if Van der Garde signed a contract with Marussia while still having a contract with Sauber, Sauber could go to that board and demand that Van der Garde stays with them.
