Arrows Outpointed In Diniz Decision.

The Arrows team has lost its claim over compensation following Pedro Diniz's defection to the Sauber team, after the FIA Contract Recognition Board ruled in the Brazilian's favour.

Arrows believed that it had secured the services of Diniz for a second year, and were disappointed to learn of his move to the Swiss Sauber team, claiming that it had a valid contract with the Brazilian. The FIA board, however, decided that Diniz had a performance-related get-out clause in the agreement, which he was entitled to use following the team's poor display in 1998.

Arrows was particularly upset to have lost the valuable sponsorship money that Diniz would have contributed to the 1999 campaign, further fuelling its desire to appeal over the driver's move, but the ruling now means that the Brazilian is legally entitled to drive for Sauber in 1999.
